The Special Marriage Act was introduced in 1954 as a progressive step to establish a legal framework for marriages, offering an alternative framework outside the purview of religious laws. Despite being one of the most progressive legal provisions in modern India, the act still does not adequately protect or recognise the rights of LGBTQ+ individuals, leaving many without legal protections and privileges. This discussion puts the focus on the necessity of reforming the SMA to bring it up to par with similar legislatures in Asia and the rest of the world. We also hope to highlight the importance of including the recognition of same-sex marriages, protection against discrimination, and the legal rights of LGBTQ+ couples, such as adoption, inheritance, and spousal benefits. This debate also underscores the larger struggle for equality in India for cultural and religious minorities, seeking to build a society where all individuals, regardless of identity, are treated with equality and dignity.

We hope to have a vibrant discussion upon this issue, as relevant today at it was in 1949, and with the benefit of retrospect, perhaps re imagine history for India.
