Position Paper for the Russian Federation in the case of Federal Republic of Yugoslavia v United States of America: The legality of the use of force
Considering the reasoning of this Court following the application of Yugoslavia on 29 April 1999, this Court solely has jurisdiction if the United States of America gives its consent. Admitting that so would happen the following issues are presented to this Court; whether the sovereignty of Yugoslavia has been violated and if such could be justified.
In light of article 2 (4) UN charter the use of force against the territorial integrity or political independence against any state is prohibited.
